With homestead patent, applicants can acquire alienable/disposable lands with a condition that applicant should cultivate and reside in the property. Homestead applications should be filed in DENR-Community Environment and Natural Resources Office.

- Applicant should have actual occupation and their residence

- Who can apply in the Homestead Patent?

Under the DAO-2002-13 dated back last June 24, 2002, married woman are qualified to apply for homestead patent.
- Miscellaneous Sales Patent
According to the Republic Act No. 730, alienable and disposable lands can be sold even without public auction, mainly for residential purposes.
Qualifications:
- Applicant must be a certified Filipino citizen
- Applicant must be of legal age.
- For singles, applicant must be the bread winner of their family
- Applicant must not own a home lot where the land applied is currently located
Requirements:
- Application Fee – Php 50.00
- Technical description of the property as well as the approved plan
- Affidavit that states that applicant does not own any home lot situated in the same municipality or city.
Steps:
- Investigation and appraisal
- Land Survey
- Investigation report
- Comment from the District/City Engineer
- Recommendation from the PENRO
- Appraisal approval
- Notice is posted in the CENRO bulletin board, on the land, Municipal bulletin board, barangay bulletin board
- Payment of appraised value for at least 10%
- Order of Award
- Full payment proof
- Issuance order of Miscellaneous Sales Patent
- Approval with signature
- Transmittal
- Proof of ownership over the land
Certificate of Title from the Register of Deeds should be provided as a proof of ownership. In the absence of the Certificate of Title, applicant must present a tax declaration together with the actual possession to claim the ownership of the land.
- Things you need for the Subsequent Registration of Title;
- One can effectively transfer a title after presenting a Deed of Sale document. This document certifies that the registered owner is legally transferring the ownership of the land to the buyer.
- Clearances also needs to be obtained. Before doing so, you first need to pay the Capital Gains Tax and other taxes in the BIR.
- After paying all the necessary payments, you will be issued with a clearance which will then be submitted to the Register of Deeds, accompanied by the Title.
- Transfer of Ownership in case the owner dies
