Many Overseas Filipino Workers suffer from abuse and maltreatment rendered to them by their sponsors and employers. Sadly, most of these OFWs are victims of illegal recruitment. Fortunately, filing a case against these illegal recruiters are now fast and easy. Here’s how;
Requirements:
- Verified copy of complaint – 5 pieces
- For cases related to Recruitment Violations
- Verified list of the agency’s personnel
- Verified Status of the Agency
- Acquire a Request to Docket Case coming from the Conciliation Unit
- For cases related to Disciplinary Action
- OFW Record or an Information Sheet
- Acquire a Request to Docket Case coming from the Conciliation Unit
Procedure:
Step 1: File your complaint accompanied by the documents listed above at the 3rd Floor Docket and Enforcement Division.
Step 2: You will need to draw a numbered pingpong ball to identify who will take charge of your case.
Step 3: Then will now hand you a copy of your complaint with a “Received” stamp. It also contains the case number and the Overseas Employment Adjudicator (OEC) that will handle your case.
Step 4: Wait until the hearing notice.
What are the penalties for illegal recruitment?
(a) Any person found guilty of illegal recruitment shall suffer the penalty of imprisonment of not less than six (6) years and one (1) day but not more than twelve (12) years and a fine not less than two hundred thousand pesos (P200,000.00) nor more than five hundred thousand pesos (P500,000.00).
(b) The penalty of life imprisonment and a fine of not less than five hundred thousand pesos (P500,000.00) nor more than one million pesos (P1,000,000.00) shall be imposed if illegal recruitment constitutes economic sabotage as defined herein.
Provided, however, that the maximum penalty shall be imposed if the person illegally recruited is less than eighteen (18) years of age or committed by a non-licensee or non-holder of authority.
